About Jacob

Jacob Goldberg is a litigator based in the Portland office. His practice focuses on commercial litigation, including securities litigation, contract disputes, complex business litigation, competition matters, trade secret misappropriation, class action litigation, internal business disputes, real property disputes, and data breach litigation. Jacob also advises clients on privacy related matters, especially with regard to regulations governing biometric information.

Before joining Stoel Rives, Jacob served as a law clerk for the Honorable Susan P. Graber of the U.S. Court of Appeals for the Ninth Circuit (2015–2016).

  • Represented power company in litigation related to rights of preferred and common shareholders in merger transaction with Special Purpose Acquisition Company.
  • Represented complex metals manufacturer in international arbitration regarding the terms of a long-term agreement with Malaysian supplier.
  • Represented electric distribution cooperative in dispute with generation and transmission cooperatives regarding energy rates and terms of wholesale power contracts.
  • Assisted in representation of complex metals manufacturer in international arbitration, seeking indemnification for breaches of representations and warranties in securities purchase agreement.
  • Assisted in representation of national restaurant company in New York state court action alleging breach of contract, and breach of the duty of good faith and fair dealing.
  • Represented solar energy provider in federal court dispute alleging violation of a power purchase agreement and unjust enrichment.
  • Represented closely held businesses and investors in pre-litigation disputes under operating agreements and bylaws.
  • Represented financial advisory company in FINRA arbitration regarding expungement of information from CRD record.

Privacy and Competition Litigation

  • Represented software company in class action litigation asserting claims under the Illinois Biometric Information Privacy Act.
  • Represented third-party healthcare benefit administrator in Oregon state court action alleging violations of the Oregon insurance code and the Public Accommodation Act, and aiding and abetting employment discrimination.
  • Assisted in representation of consumer financial services company in class action alleging violations of the Fair Credit Reporting Act, the California Investigative Reporting Agencies Act and the Consumer Credit Reporting Agencies Act.
  • Represented large event management software company in federal court proceeding alleging trade secret misappropriation, copywrite infringement, and breach of contract.
  • Represents property owners and developers in pre-litigation disputes involving nuisance allegations.
  • Represented surrogacy agency in federal court action alleging violations of the Computer Fraud and Abuse Act, trade secret misappropriation, intentional interference with business relations, and defamation.
  • Assisted in representation of music publisher action in antitrust action alleging violations of Sections 1 and 2 of the Sherman Antitrust Act.
  • Serving as local counsel in class action litigation alleging RICO violations in the baby food industry.
  • Counsel clients on compliance with privacy statutes and regulations
  • Counsel and advise clients on the collection and use of biometric information.

Real Property, Product Liability, and Tort Litigation

  • Represented sports organization in claims under the Oregon landlord tenant act.
  • Representing home improvement company in trespass action in state court.
  • Represented and obtained dismissal of claims against realtor alleging financial elder abuse.
  • Assisted in representation of auto manufacturer in products liability action alleging violations of Washington Product Liability Act.
  • Obtained dismissal of action against non-profit housing organization and faith organization attempting to construct and operate the first homeless shelter in Ontario, Oregon. Drafted and argued successful opposition to motion for a preliminary injunction.
  • Represented tenant in dispute alleging unlawful and discriminatory towing of her vehicle by landlord. Obtained settlement equivalent to full value of vehicle.
