About Cory

Cory Carone helps businesses and individuals solve difficult legal problems, representing clients in litigation, appeals, and investigations.

Cory’s litigation practice focuses on commercial contract disputes, business and toxic torts, real property disputes, and environmental contamination claims. He also specializes in First Amendment issues, particularly related to defamation claims, freedom of the press, public protests, and congressional and legislative redistricting. In his appellate practice, Cory has represented clients in state and federal appellate courts across the country, including the United States Supreme Court. But he focuses on appeals before the Idaho Supreme Court and the Ninth Circuit. He, for example, has worked on several original actions before the Idaho Supreme Court addressing pressing constitutional issues related to ballot initiatives, legislative redistricting, and freedom of the press. In his investigations practice, Cory assists companies and boards of directors with government and internal investigations. He has helped clients respond to investigative demands from the DOJ, SEC, and state regulatory agencies. He has also led internal investigations, particularly related to alleged workplace misconduct.

Before joining Stoel Rives, Cory was a Deputy Attorney General for the State of Idaho and an associate with Jones Day. He also clerked for the United States Court of Appeals for the Sixth Circuit and the United States District Court for the Eastern District of Michigan.

First Amendment

  • Counseled senior public officials on First Amendment and other constitutional issues related to an overnight encampment at Idaho’s Capitol.
  • Counseled a vacation company responding to false and disparaging statements made about an employee.
  • Represented an individual in a defamation action related to false statements that he exposed himself at a public event.
  • Represented an individual in a defamation action related to false statements that she participated in a murder.

Appeals

  • Represented the Idaho Commission for Reapportionment and Idaho’s Secretary of State in an original action before the Idaho Supreme Court challenging the redistricting of congressional and legislative maps.
  • Represented the State of Idaho and Idaho’s Secretary of State in an original action before the Idaho Supreme Court challenging laws regulating ballot initiatives and referenda.
  • Represented government employees in an appeal before the Ninth Circuit related to alleged violations of the Eighth and Fourteenth Amendments.
  • Represented the State of Idaho and Idaho State Police in an appeal before the Idaho Supreme Court related to governmental immunity.
  • Represented a media coalition in an original action before the Idaho Supreme Court challenging a gag order in a criminal matter.
  • Drafted an amicus curiae brief submitted to the Supreme Court of the United States in Ford Motor Co. v. Montana Eighth Judicial District Court advocating for limiting specific jurisdiction to cases in which the defendant’s forum contacts are causally connected to the plaintiff’s claims.

Commercial Contract Disputes

  • Counseled a sports venue, hospitality companies, and manufacturers on initial responses to Covid-19, including the application of force majeure clauses.
  • Represented a landlord in litigation against a tenant that breached a long-term lease.
  • Represented an investment fund in litigation against a company and individuals that breached the terms of an investment agreement.
  • Represented a technology company in a dispute related to a retailer unlawfully selling the technology company’s products.
  • Represented a construction management company in a dispute related to services provided during a casino construction project.

Investigations

  • Advised an international construction company in relation to a DOJ and SEC investigation of its accounting practices.
  • Represented a public official in a state investigation of obstruction of justice.
  • Advised a healthcare provider in relation to a federal investigation of alleged False Claims Act and Anti-Kickback Statute violations.
  • Represented a healthcare provider in relation to a state licensing board investigation.

Employment

  • Represented a manufacturer in an OSHA matter related to alleged retaliation against a whistleblower.
  • Successfully resolved a sexual harassment claim before the Idaho Human Rights Commission.
  • Investigated allegations of workplace discrimination related to age and sex discrimination.

Other Matters

  • Won a motion to dismiss a challenge to Idaho’s Governor’s decision to end unemployment insurance benefits first offered under the CARES Act.
  • Defended a manufacturing company in nationwide litigation over alleged environmental contamination from products containing PFAS chemicals.
  • Defended a public university in mass tort litigation related to alleged sexual misconduct by a former employee.
  • Successfully resolved a claim of patent infringement by a non-practicing entity.
  • Advised Idaho’s Legislature on the constitutionality of draft legislation.
