In an article for Artisan Spirit Magazine, Corey Day and Robert Sarkisian outline some considerations for a distillery, whether a small operation in one state or larger one operating across multiple states, regarding the trend towards “pay transparency”—a requirement increasingly being enacted into law by states throughout the U.S. that job postings include specific compensation information.

Litigator and alcoholic beverage attorney Day and employment law attorney Sarkisian note that the increase in the number of such laws is also making apparent inconsistencies and ambiguities that exist in some of them. As an example, an employer advertising for workers for remote work opportunities—which can be done anywhere—may now need to determine if it will need to meet its home state’s pay disclosure requirements in job postings in other states.

Day and Sarkisian conclude: “The original purpose of these pay disclosure laws was to eliminate any inequity among employees working the same position. While that remains to be seen, the immediate effect these laws have had are adding to companies’ ever-growing burden to comply with yet another ambiguous law. Therefore, it is important to discuss with experienced employment counsel before moving forward with any job postings.”
