Renewable Developers Race to Meet Changing Tax Credit Rules

Abstract
Brian Nese, Partner in the Energy Development group at Stoel Rives, outlines how renewable energy developers are navigating a shifting regulatory environment driven by recent legislative changes, including provisions from the One Big Beautiful Bill Act. These evolving tax credit structures are influencing how projects are initiated, structured, and financed.
Nese emphasizes that while new laws are in place, critical regulations and executive orders are still forthcoming, creating a dynamic landscape for energy clients. He shares that Stoel Rives is working closely with clients to design flexible, forward-looking strategies that both comply with current rules and anticipate future developments. Strong partnerships with vendors and counterparties, he notes, will be essential for project success in this uncertain environment.

I am Brian Nese, partner in the Stoel Rives Energy Development group based in San Diego, California.
Clients across the firm are dealing with legislative and regulatory changes affecting all phases of their business. The renewable energy industry is feeling this acutely with the changing landscape on renewable energy tax credits coming out of the One Big Beautiful Bill Act. We are spending a lot of time here at Stoel advising clients on how to begin construction on projects, and structure projects to maximize available incentives, and shore up projects against the changes that are about to become effective.
The story is still being written even though these new laws have been enacted. There are regulations and executive orders that are still pending that are going to impact how businesses actually respond to these laws. We are working actively with clients to develop creative, nimble solutions to adapt to the law as written while anticipating more changes yet to come.
It will be important for clients to develop strong relationships with counterparties and vendors. Companies are going to have to work together to navigate this changing landscape and have projects be successful.
