Overview

Bradley Prowant represents an array of clients in all aspects of complex commercial litigation and appellate advocacy in state and federal jurisdictions throughout the United States. Bradley’s practice focuses on dispute resolution in the agribusiness and food and beverage industries where he advocates for clients from pre-suit through trial and appeal. Bradley has tried several cases to verdict and argued appeals through to opinion in multiple federal circuit courts and state appellate courts.  Additionally, Bradley has meaningful experience with federal rulemaking before the United States Department of Agriculture, having seen through to final rule the longest Federal Milk Marketing Order hearing. Bradley also navigates clients through intricate federal regulations and interactions with federal agencies. In particular, Bradley is interested in laws and regulations regarding agricultural cooperatives and how to utilize the unique corporate structure of a cooperative to help clients obtain their business goals.

Bradley has significant experience with insurance coverage litigation with both insurers and policyholders. He has a diverse commercial litigation practice having represented small and large companies in the energy, medical device, real estate, and technology industries on claims of breach of contract, breach of fiduciary duty, defamation, fraud, and tortious interference. Bradley also has an active pro bono practice helping otherwise unrepresented clients protect their constitutional rights and pursue claims against offenders.

Bradley is a member of the Firm’s Agribusiness Industry Group, Insurance Recovery Group, and is the co-chair of the Associates Committee. He is a former member of the Inclusion subcommittee that provided firm wide culture and inclusion programming and is active in mentoring young associates. Prior to joining Stoel Rives, Bradley practiced at a boutique litigation firm and served as a judicial law clerk for a trial court judge in Saint Paul, Minnesota.

Experience

Agribusiness, Food and Beverage

  • Represented the largest organic dairy cooperative in the country in a dispute with former member.
  • Represented large trade association made up of 25 dairy cooperatives in the longest formal rulemaking hearing before the United States Department of Agriculture, Dairy Program seeking regulatory changes to Federal Milk Marketing Orders.
  • Defended large agribusiness company in breach of contract dispute.
  • Represented beverage co-packer in breach of contract action with brand owner.
  • Represented beverage distributors in pre-suit disputes with suppliers regarding sales of retail brands and termination of distribution rights.
  • Advised multiple retail clients on state beverage laws and regulations related to sales, tied-house, advertising, and related industry issues.
  • Multiple ongoing matters with agricultural clients.

Commercial

  • Assisted with insurance recovery efforts after client’s business suffered a total loss that exceeded amounts insurer was willing to cover.
  • Represented insurer in contribution action arising out of superfund site.
  • Defended large renewable energy company in dispute with former contractors in connection with 200MW wind farm development.
  • Tried case for client plaintiff medical device distributor in lawsuit with product manufacturer on claims of breach of contract and tortious interference.
  • Defended real estate licensee in action by state agency to revoke license.
  • Helped small business reach pre-suit resolution in potential product liability action.
  • Represented owner of commercial enterprise in dispute with local regulators over use and operation of property.
  • Defended an international medical device company from claims of defective design, defective manufacturing, and failure to warn.
  • Represented prominent estate in dispute and appeal alleging breach of contract and breach of fiduciary duty by former agents and attorneys.
  • Represented franchisee in breach of contract dispute challenging commercial reasonableness of franchise agreement.
  • Represented limited liability company and one of its members in dispute with another member involving claims of breach of contract, defamation, and tortious interference.

Pro Bono

  • Represented non-profit in lawsuit against Texas state actors after passage of restrictive voting law the infringed on client’s constitutional right to vote.
  • Represented former patients of the Minnesota Sex Offender Program in lawsuit against State agency for failure to follow court orders.
  • Obtained significant jury verdict for client who was defamed following drag show performance in Northern Idaho.
