LUBA Affirms County Approval of Rest Area Project

After four appeals, the Land Use Board of Appeals affirmed Jackson County’s 2009 decision to approve the construction of an Oregon Department of Transportation highway rest area. The petitioners in the appeals own agricultural land near the proposed site of the rest area.

In response to the first appeal after the county’s 2009 approval, ODOT proposed to use city water for potable or domestic uses and obtain water for landscaping irrigation from other sources, and an amendment was approved to the condition of approval. Further petitions over the approval of the amendment were rejected by the Board.
