Experience
Krista McIntyre focuses her practice on environmental law, including environmental permitting and enforcement defense. She handles air quality matters, including New Source Review (NSR) and Title V permitting, air shed management, and regulatory interpretation. Krista represents clients before state and federal regulatory agencies. She participates in state rule development and contested case proceedings before the Board of the Idaho Department of Environmental Quality that involve Clean Air Act (CAA) programs including NSR, Title V, Hazardous and Toxic Air Pollution Control, and New Source Performance Standards (NSPS). Krista defends industrial clients in federal and state CAA enforcement actions that involve alleged violations of NSR permitting requirements, such as prevention of significant deterioration (PSD) and implementation of other CAA compliance requirements. She also counsels clients in the development of corporate environmental management systems and participates in multimedia compliance assessments on behalf of environmental clients.
Krista is a former managing partner of Stoel Rives' Boise office (2000-03), has served on Stoel Rives' Executive Committee (2004-07), and currently serves as Partner for Professional Development.

- Confidential Energy Client-Defended an administrative appeal of a proposed new source review permit authorizing construction of a combined-cycle natural gas plant. Union members challenged the selected emissions control technology and the emissions limits proposed in the permit. The matter was dismissed for lack of standing by a hearing officer representing the Board of the Idaho Department of Environmental Quality.
- Confidential Energy Client-Evaluated implementation of the Clean Air Mercury Rule and other air quality requirements for proposed large-scale coal-fired power plant.
- Biofuels Developers-Represents ethanol plant developers in permit strategy and implementation.
- Confidential Manufacturing Client-Led internal investigation in response to federal inquiry into possible criminal violations of the CAA.
- Confidential Manufacturing Client-Assists clients in developing strategies for historic PSD applicability reviews and presentations of results to permitting agency.
- Confidential Manufacturing Clients-Advises clients from different industries, such as chemical process, pulp and paper, cement manufacturing, glass manufacturing, acid producers, and food processors, on CAA compliance and implementation.
