Stoel Rives attorney Wes Miliband authored an article for the Daily Journal titled “Water challenges, public and private.” The article discusses actions taken in California to address the effects of its severe, four-year drought, including the enactment of a mandatory statewide groundwater regulatory program and measures to curtail surface water rights that date to 1858.

With executive orders in the past year mandating water conservation measures; voters passing Proposition 1 (a $7.5 billion bond expected to provide funding for water projects); and the new Sustainable Groundwater Management Act mandating sustainable groundwater use, Miliband contends that long-term sustainability depends on efficient use of water, while not substituting vested water rights involuntarily, with proactive efforts by local agencies and private stakeholders a critical linchpin for success.
