About Rachel

Rachel Cox is an associate in the firm’s Environment, Land Use and Natural Resources practice group.  She represents industries, municipalities and trade associations in permitting, compliance and enforcement matters arising under state and federal environmental laws.  Rachel focuses her practice on Clean Air Act permitting, compliance and enforcement defense.

Rachel graduated with honors from Lewis and Clark Law School, earning a Certificate in Environmental and Natural Resources Law. While there, she served on the editorial board of Environmental Law, the nation’s oldest law review dedicated solely to environmental issues. As an environmental engineering major, Rachel has the scientific background and expertise to comprehend the technical issues clients face and provide comprehensive legal counseling tailored to their needs.

Experience

Experience

  • Assist with permitting and provide advice on compliance with the Clean Air Act new source review and prevention of significant deterioration programs, as well as local air quality regulations.
  • Track and advise clients on regulatory updates to EPA’s New Source Performance Standards and National Emission Standards for Hazardous Air Pollutants.
  • Counsel industries and trade associations in rulemaking proceedings for air regulation, including greenhouse gas reasonably available control technology rules and the Washington regional haze SIP.
  • Represent clients in enforcement proceedings, including responding to Clean Air Act § 114 information requests, negotiation of civil penalties and defense of non-compliance allegations.
  • Assist data centers nationwide with Clean Air Act compliance and other applicable environmental regulatory requirements, including RCRA, EPCRA and CWA.
  • Defend appeal to industrial client’s CWA National Pollutant Discharge Elimination System permit.
  • Advise Native Alaska regional corporation on State of Alaska’s development of proposed new hydroelectric dam on its lands.
