About Shannon

Shannon Morrissey is an associate in the firm’s Environmental practice group. She has experience with permitting, transactional and natural resources matters. Shannon currently serves as the Associates Committee Representative for Stoel Rives’ California offices, and on the Executive Committee for the San Francisco Bar Association, Barrister’s Environmental, Land Use and Real Estate section.

Prior to joining the firm, Shannon was a summer associate (2014) and law clerk (2014-2015) with Stoel Rives LLP and an extern for the State Water Resources Control Board (2014) and the Attorney General, Public Rights Division (2013), in Sacramento, California. She also conducted research and composed summaries of environmental issues covering water policy, air quality and energy and natural resource issues for the Southern Environmental Law Center in Birmingham, Alabama (2013).

Experience

  • Represented major industrial manufacturer in administrative enforcement proceeding before the South Coast Air Quality Management District’s Hearing Board, and assisted with successful negotiation for curtailment of air emissions at facility.
  • Prepared various transactional agreements for agricultural client, including purchase and sale agreement for excess agricultural production.
  • Represented oil and gas client in investigation and enforcement action by county district attorney for alleged hazardous waste liability issues, and negotiated favorable settlement agreement to complete investigation.
  • Represented industrial client in negotiations with the U.S. Environmental Protection Agency, Region IX as to de minimis settlement offer for CERCLA disposal site.
  • Successfully negotiated settlement agreement between recycling corporation and CERCLA potentially responsible party (PRP) group.
  • Represented oil and gas client in administrative appeal of order issued by the California Department of Conservation.
  • Advised oil and gas client on notification requirements for spill or release liability under state and federal law, including potential enforcement authority of the State Water Resources Control Board, and the Division of Oil, Gas, and Geothermal Resources (DOGGR).
  • Counseled major oil and gas corporation on environmental liability issues in bankruptcy proceeding, and represented client in communications and filings before the California State Lands Commission related to assets in bankruptcy.
  • Advised industrial client on potential impacts to mineral production, and options for combatting impacts, identified in Environmental Impact Report for solar development in southern California.
  • Assisted major energy company in procedures pursuant to President Trump’s Executive Order on the Review of Designations Under the Antiquities Act (EO 13792).
  • Successfully challenged city’s imposition of development impact fees at industrial facility, and advised client in city administrative proceedings related to land use permits.
  • Conducted due diligence and permit review for financing opinions for large solar developments throughout California.
  • Provided counsel on legal authority for noise nuisance curtailment at renewable facility, including review of Public Utilities Commission opinions.
  • Advised client on various state and local compliance issues related to land use requirements for energy storage project.
  • Advised client on various state and local compliance issues related to permitting requirements for recycling activities at industrial facility.
  • Advised a major beverage company on zoning, land use, and alcohol permitting issues throughout the state of California.
  • Represented land use developer in challenge to city’s delay in approval of land use permits, and identified violations of state and local law committed by the city.
  • Counseled client on land use issues related to shared wall at commercial facility, and obtained local building records through California Public Records Act request.
  • Represented major corporation in more than five eminent domain matters in which State of California sought to obtain land for High Speed Rail development.
  • Provided advice on various matters related to water rights and water supply under state and federal law.
  • Successfully defended several major industrial corporations, including product manufacturer and oil company, in Clean Water Act citizen suits arising from concerns over storm water runoff at facility.
  • Advised client on air quality compliance requirements, including timelines and allowances, for the EPA’s Transition Program for Equipment Manufacturers (TPEM) for diesel equipment manufacturers.
  • Represented industrial client in matter before the Central Valley Regional Water Quality Control Board regarding the CERCLA lender liability exemption (safe harbor).
  • Successfully challenged state administrative agency penalty imposed on agricultural client by defeating Motion for Summary Judgment before the Washington Pollution Control Hearings Board.
  • Represented client in land use permitting for residential development under Senate Bill 375, advised on CEQA matters for the proposed development, and negotiated development agreement with City Attorney and staff.
  • Successfully represented pro bono clients in guardianship proceeding, obtained approval for Special Immigrant Juvenile Status in federal immigration proceeding, and received approval for Lawful Permanent Residence status (Green Card).
  • Represented pro bono client in divorce proceeding, and related domestic violence issues, through the Bar Association of San Francisco’s Justice and Diversity Center.
