About Elijah

Elijah represents companies of all shapes and sizes through all phases of the trial process in both state and federal courts. He handles complex matters ranging from multi-decade class action lawsuits and cross-country trademark disputes to product liability and construction defect cases. Elijah has consistently proven himself to be an effective litigator uniquely able to distill complex fact patterns and legal minutiae down to the heart of an issue in ways that are both understandable for his clients and persuasive for courts. 

An avid cyclist and rock climber, Elijah has litigated on behalf of several clients in the outdoor industries and recreation space. Representative matters include mediation on behalf of a ski resort and one of its commercial tenants over lease arrangements; settlement on behalf of a tactical clothing and outdoor equipment company arising from a breached supply agreement; advising a crash pad bouldering company on liability waivers; and litigating on behalf of a renowned golf course on claims of trademark infringement, dilution, unfair competition, and cybersquatting.

In addition to his extensive client work, Elijah regularly provides pro bono counseling to domestic violence victims, political asylees and endangered children. Prior to moving back home to his native Idaho and joining Stoel Rives, Elijah practiced complex commercial litigation at the Chicago office of one of the world’s largest law firms.

  • Representing renowned Michigan golf course in federal litigation involving trademark claims under the Lanham Act, including trademark infringement, unfair competition, trademark dilution, cybersquatting, and various state law claims.
  • Representing plaintiffs’ class action against the State of Idaho arising from various health care, security and constitutional violations.
  • Defending modular building manufacturer against warranty claims brought by fish hatchery. 
  • Defending orthopedic implant manufacturer against unfair competition claims in Florida.
  • Defending bottler in multi-party dispute over water rights and property redemption. 
  • Defended Las Vegas surety in litigation involving a multi-million dollar housing project on tribal lands.
  • Defended Silicon Valley green tech building supplier against various state-based defect and warranty claims.
  • Negotiated on behalf of financial advisor defending against ERISA claims before the Department of Labor.
  • Represented international telematics corporation during a week-long arbitration against its competitor for breach of contract claims. 
  • Represented and advised crash pad bouldering company regarding liability waivers and general risk assumptions between manufacturers and end-users. Represented a Utah-based manufacturer during litigation in the Northern District of Illinois involving millions of dollars in fitness equipment.   
  • Part of the litigation team that obtained full dismissal of all claims through summary judgment on behalf of an international retailer faced with legal challenges to its Drug and Alcohol-Free Workplace Policy.  
  • Second-chaired a three day federal bench trial involving alleged wrongful termination and secured full dismissal of all claims on behalf of a national consumer satellite entertainment company.
  • Represented ski resort, condominium association, and management company during all-day mediation with commercial tenant for remunerations with favorable results.
  • Obtained favorable settlement on behalf of California-based tactical outdoor clothing and equipment company regarding complex contract disputes arising from defective products designed for first responders.
  • Part of the trial team which secured a stipulated dismissal with prejudice for a South American mobile phone network provider in a multimillion-dollar action involving director and officer equity options.
