About Andrea
Andrea Thompson has a specialty in education law and is the firm’s internal resource on issues facing the education industry. She advises and defends private and public schools, colleges, and universities in a variety of matters that are unique to education institutions.
She has represented clients in U.S. Department of Education Office for Civil Rights (OCR) enforcement actions and employment-related matters involving staff, faculty, and administrators in agency, state, and federal proceedings. She has also defended clients in numerous discrimination, civil rights, section 1983, retaliation, whistleblower, disability, wage-and- hour, workplace tort (such as wrongful discharge), and contract disputes.
Andrea advises and counsels education clients on legal compliance and litigation prevention strategies, with an appreciation of honoring institutions’ educational missions, for a wide range of student affairs and staff and faculty employment matters, including:
- Policy and practice development for student conduct and disciplinary boards,
- Title IX and Clery Act, including Violence Against Women Reauthorization Act of 2013 (VAWA) and Campus SaVE Act compliance,
- Family Educational Rights and Privacy Act (FERPA) and other student privacy laws,
- ADA Titles II/III, section 504 compliance, and student disability services, and
- Title IV and financial aid.
Andrea also represents employers in all areas of employment law, with an emphasis on defending lawsuits and administrative charges, and resolving employment-related disputes.
Her experience covers litigating discrimination, retaliation, and whistleblower claims; wage-and-hour issues; workplace torts, such as wrongful termination; and contract disputes.
She has defended health care organizations; manufacturing, technology, and forest products companies; higher education institutions; and nonprofit and public entities. Drawing on her litigation experience, Andrea also advises employers on litigation prevention strategies and practical legal compliance.
