REGULATORY UPDATE FOR NOVEMBER 23 (COVERING WEEK OF NOVEMBER 16)

Our energy regulatory team has compiled a list of state and federal energy regulatory developments to keep you up to speed on key energy regulatory matters from across the United States. Stoel’s energy regulatory team is always available to answer questions about any of these developments.

CPUC

At its voting meeting last week, the CPUC approved new proforma QF contracts for the modified pricing structure it adopted in May 2020. It also opened a new rulemaking to ensure reliability in the event of an extreme heat storm in the summer of 2021. 

CAISO

The CAISO Board of Governors adopted the Hybrid Resources Phase 2 proposal last week. The proposal is intended to clarify how hybrid and collocated resources will be treated under the CAISO tariff. 

California Court of Appeals

A California appellate court upheld a superior court decision finding that a statute requiring all appeals of California Energy Commission siting decision for thermal power plants to go directly to the California Supreme Court was unconstitutional.
