REGULATORY UPDATE FOR JULY 6 (COVERING WEEK OF JUNE 29)
Our energy regulatory team has compiled a list of state and federal energy regulatory developments to keep you up to speed on key energy regulatory matters from across the United States. Stoel’s energy regulatory team is always available to answer questions about any of these developments. Energy regulatory highlights for this week include:
California Public Utilities Commission
On June 26, 2020, the California Public Utilities Commission issued an Assigned Commissioner’s and Assigned Administrative Law Judge’s Ruling seeking comment on proposed modifications to its Renewable Market Adjusting Tariff (ReMAT) program, including a Staff proposal to use administratively determined prices by product category with a time-of-delivery adjustment.
Federal Energy Regulatory Commission
On June 30, 2020, the United States Court of Appeals for the District of Columbia Circuit issued a decision in Allegheny Defense Project v. Federal Energy Regulatory Commission, striking down FERC’s use of tolling orders to extend the time for it to respond to requests for rehearing.
