Tim O’Connell Quoted on New Washington State Salary Transparency Law

In a recent article, Tim O’Connell offers his take to Law360 on difficulties employers might encounter in following the requirements of Washington’s recently enacted Senate Bill 5761, which amends Washington’s Equal Pay and Opportunities Act to require employers in the state with at least 15 workers to include salary ranges and benefits in job postings.

According to veteran labor and employment attorney O’Connell, employers fear the new law may lead to candidates pushing for a salary at the high of the range listed for a job and may give pause to employers based outside Washington in hiring workers who live in the state.

“If you’ve got an employer who is not resident within the state of Washington and would be interested in preserving its existing practices in this regard, what jurisdiction does the state of Washington have on them to say that they’ve got to comply anyway?” O’Connell said.
