Proximity to U.S. Military Installation Likely Triggered Presidential Order Blocking Chinese-Owned Wind Projects

Stoel Rives attorney CJ Voss added to his own extensive reporting on the recent Presidential Order blocking development of four Chinese-owned wind projects with comments to SNL Renewable Energy Weekly.

In the SNL article, Voss observed that the wind farm's proximity to a naval base was the likely trigger for the government's finding that the acquisition and operation of the wind projects could pose a national security risk. "Having a Chinese acquirer operating facilities proximate to a U.S. military installation must have been viewed as problematic," he said. He added that many wind developers and their attorneys may not be aware of national security concerns when developing or acquiring a project. "It's not typically part of the due diligence. It's probably now something that you have to include on your due diligence list with the acquisition of a company with real property and hard facilities on the ground."
