Tax attorney Greg Jenner was quoted in Law360 in an article titled “IRS Neutrality May Suffer Under New IRS Head’s Dual Role.” The article discusses the proposed appointment by President Trump of David Kautter as interim IRS Commissioner after outgoing Commissioner John Koskinen’s term expires.
The appointment of Kautter, the newly appointed U.S. Department of the Treasury assistant secretary for tax policy, is raising concerns about how the IRS can remain neutral while Kautter fulfils his existing duties to guide politically-directed tax policy changes.
“I have no doubt that Dave [Kautter] would do the right thing but it’s a perception issue,” Jenner said. “Here you have somebody holding a clearly political role and attempting to run an agency that is supposed to be apolitical. It’s a damned situation to put somebody in."
