A Stoel Rives tax alert received coverage in Biodiesel Magazine late last week. At issue was the extension by the IRS of a deadline for filing claims for payments for certain biodiesel mixtures and alternative fuels.
The alert describes how the American Taxpayer Relief Act of 2012, enacted January 2, 2103, retroactively extended income tax credits for certain biodiesel mixtures and alternative fuels, along with an excise tax credit through 2013. However, the deadline for filing 2012 claims for the excise tax credit had already passed before the Relief Act was passed.
On April 3, 2013, the IRS issued Notice 2013-26, which extended the deadline for payments for biodiesel mixtures and alternative fuels produced or sold in 2012 to July 1, 2013.
