REGULATORY UPDATE FOR AUGUST 24 (COVERING WEEK OF AUGUST 17)

Our energy regulatory team has compiled a list of state and federal energy regulatory developments to keep you up to speed on key energy regulatory matters from across the United States. Stoel’s energy regulatory team is always available to answer questions about any of these developments. Energy regulatory highlights for this week include:

California Public Utilities Commission

In the wake of California ISO’s rolling blackouts a week and a half ago, the Commission has large number of resource adequacy agreements on its agenda for its voting meeting this week, including agreements with gas fired generation in Southern California, and energy storage agreements with Pacific Gas and Electric and Southern California Edison.

Minnesota Public Utilities Commission

On August 20, 2020, the Minnesota Public Utilities Commission (“Commission”) approved Minnesota Power’s interim-rate refund plan in connection with the Company’s rate-case resolution.

The Commission also reviewed and accepted the utilities’ July 2018 to December 2019 Annual Automatic Adjustment Reports; however, the Commission referred the matter of Minnesota Power’s forced outages surcharge to the Office of Administrative Hearings for a contested-case proceeding.
