Important Changes to Nondisclosure and Settlement Agreements
Since going into full effect in 2019, Oregon’s Workplace Fairness Act has imposed significant limitations on confidentiality, nondisparagement, and no-rehire terms in settlement agreements. Effective January 1, 2023, it will be even more challenging to include these terms. In Washington, that date is even sooner – June 9, 2022 – when the state’s Silenced No More Act goes into effect, retroactively. Meanwhile, the National Labor Relations Board has signaled that it may seek to examine whether these kinds of clauses violate the National Labor Relations Act. This program will cover:
