EPA Finalizes 2011 Renewable Fuel Standards

Stoel Rives attorney Graham Noyes discussed in OPIS' Renewable Fuels Supply the 2011 Final Rule issued last month by the Environmental Protection Agency ("EPA") implementing renewable fuel quantity standards under the RFS2 program. Noyes said that the nearly 14 billion gallon total renewable fuel standard set by the EPA constitutes a market penetration of over 8% into the U.S. transportation fuels market. He also reported that the EPA resolved several controversial and lingering RFS2 regulatory issues, including "Delayed RINs" and the limitation of feedstock tracking and certification waivers to U.S. sourced material.
