Brian C. Park

Overview

Brian C. Park is a litigation partner and current chair of the firm’s Technology and Intellectual Property (IP) group. He has served on the firm’s Executive Committee and Diversity, Equity & Inclusion Committee. For over ten years, Brian has also chaired the Federal Bar Association IP Committee of the U.S. District for the Western District of Washington.

A registered patent attorney, Brian handles high-stakes, high-risk litigation involving clients’ most important assets, including their technologies, secrets, brands, creative work product, and business deals. He advises clients about the full range of IP protections and helps them monetize their technology assets through commercial negotiations and agreements. In addition to patent infringement, ownership, and false marking matters, Brian handles all forms of IP conflicts (including those related to copyrights, trademarks, trade secrets, advertising, and licensing).

Apart from intellectual property, Brian has extensive experience with complex commercial litigation involving contract disputes, unfair competition, and corporate espionage. His practice includes the preparation of patent/technology opinions and commercial agreements tailored to safeguard a wide range of business interests and legal rights. His areas of technical and industry experience include the mechanical, chemical, electrical, biomedical, computer science, brand management, and industrial engineering arts. He has represented local and international clients ranging from small, privately held companies to large, global corporations.

Before joining Stoel Rives, Brian was a partner at Dorsey & Whitney LLP, an associate at Seed and Berry LLP and Bogle & Gates PLLC, and a judicial clerk to the Honorable Wilkes C. Robinson of the U.S. Court of Federal Claims.

Experience

  • Successfully enforced patent claims directed to remote-controlled, hyper-realistic, military trauma training devices, including a successful appeal to the U.S. Court of Appeals for the Federal Circuit, the entry of summary judgment on patent infringement, and the pre-trial striking of defenses as a precursor to a confidential settlement.
  • Successfully defended a complex patent infringement action by a prolific patent assertion entity involving automated video control and vehicle monitoring patents, resulting in a final judgment invalidating all claims of the asserted patents and the patentee’s abandonment of the appeal.
  • Successfully enforced client’s patents protecting automated traffic safety systems against a competitor, resulting in a judgment of patent infringement, validity, and enforceability in favor of our client, the entry of a permanent injunction against the competitor prohibiting further patent infringement and unfair competition, and the assignment of the competitor’s own patent portfolio to our client.
  • Successfully handled a Lanham Act trademark, false/misleading advertising, and deceptive trade practices litigation involving virtual currency and barter exchanges, resulting in a published decision, a judgment of false and misleading advertising, entry of a permanent injunction, and a multimillion-dollar award of damages, attorneys’ fees, and costs in favor of our client.
  • Successfully defended a high-profile patent, copyright, trademark, counterfeiting, publicity, and Lanham Act unfair competition litigation involving consumer products sold online, resulting in claim dismissal, summary judgment, declaratory judgment, and an award of attorneys’ fees and costs.
  • Successfully handled a patent, copyright, and trade dress infringement litigation protecting medical diagnostic ultrasound scanheads and probes.
  • Successfully handled a series of patent litigations protecting underground horizontal directional drilling (HDD) locating and tracking systems, resulting in multiple published decisions on patent infringement, validity and enforceability in favor of the client.
  • Successfully handled a patent litigation protecting innovative business method patents in the cargo loading industry.
  • Successfully handled a patent litigation protecting harmonic vibration damping devices.
  • Successfully handled a patent litigation protecting multistation weight resistance exercise machines, resulting in multiple published decisions on patent infringement, validity, enforceability, and damages in favor of the client.
  • Successfully defended a patent litigation involving high-pressure, audiophile subwoofers and served as a team leader in a joint defense collaboration resulting in partial summary judgment of non-infringement and preclusion of lost profits, and ultimate invalidation of all asserted patent claims.
  • Successfully developed and implemented a patent monetization and enforcement program for one of the world’s largest Internet retailers.
  • Successfully handled a series of Landham Act trademark, unfair competition and commercial litigations protecting retail consumer electronics and brands.
