Rasich Discusses the Elizabeth Smart Case with KSL News



Stoel Rives attorney Marc Rasich discussed the likely jury deliberation process with KSL News in the recently concluded Elizabeth Smart kidnapping trial. David Mitchell stood accused of kidnapping and illegally transporting Smart (then a minor) across state lines for the purposes of having sex in 2002. The defense sought a verdict of not guilty by reason of insanity. On December 10, a Salt Lake City jury found Mitchell guilty on both counts.

Rasich said that an insanity defense usually comes down to a battle of expert testimony. "In essence it's a contest. The jury needs to consider the credentials of each of the experts, the testimony of each of the experts, what the expert saw or did or relied upon in reaching their conclusion."
