Acquisition and Financing of Timberlands and Mills We have substantial experience in assisting clients in acquiring and selling large acreages of timberland, forest products, mills, and government timber contracts. We also represent a lender that regularly makes loans secured by timberlands.
Contract and Land Ownership Matters We frequently advise clients regarding contracts and other legal matters relating to ownership and operation of forest lands, including:
- state and federal timber contract matters
- preparation of private timber sale contracts
- road use and right-of-way agreements, and agreements relating to logging, sales of wood chips, or hauling of forest products
Stoel Rives also advises clients concerning the environmental issues related to forest land ownership and operation, and the forest planning process under the National Forest Management Act. We have handled a number of size determinations and appeals before the Small Business Administration for our forest industry clients.
Litigation The Forest Industries Team has a strong track record in forest industry-related litigation. We've been involved in cases regarding responsibility for forest fire damage, antitrust claims arising out of bidding practices, environmental challenges to forest operations, claims against the government arising out of federal timber contracts, and numerous claims between private parties involving breaches of contracts relating to forest operations.
Export and Trade Associations We are counsel to exporters of forest products and to several trade associations that serve the forest products industry. These engagements involve forming associations (including Webb Pomerene Associations and export trading companies), monitoring meetings, and providing antitrust advice in connection with association activities.
Taxation and Investment We have experience in federal income tax issues arising out of timberland ownership and have had significant involvement with legislation and judicial decisions involving state systems for taxation of timber and timberlands. We've represented investors, including Japanese and other foreign investors, in the purchase of timberland, mills, and other timber-related transactions.
