Public Ports

Public seaports and airports are key players in the growth and economic development of the western United States, and serve as an "economic engine" in the communities they serve. Ports face an increasingly complex regulatory arena for development activity and environmental compliance. In an era when public ports are subject to additional security constraints, these organizations need partners to help them build innovative strategies for successful growth.
The Stoel Rives Public Ports Team is dedicated to serving the evolving needs of port clients. We have successfully helped several of the largest seaports and airports in the West solve complex regulatory and infrastructure problems that would have otherwise affected operations. Our ports practice focuses on:

  • local, state, and federal permitting
  • regulatory and litigation matters related to the Endangered Species Act, air quality, the Clean Water Act, shoreline and other land development permitting, and hazardous waste clean up
  • SEPA, NEPA, and CEQA project review
  • NPDES permits
  • water rights acquisition
  • harbor maintenance and deepening programs

We also assist ports in facility expansions and in planning and permitting infrastructure development, including municipal water and wastewater systems, public transportation systems, airport runways, and dock and marina facilities. We have successfully guided ports to innovative cash-out settlements, accessing historical insurance policies to provide expedited funding for major environmental cleanups. The team is nationally known for its litigation practice in two areas of particular interest to ports and other large public landowners-public trust and water boundary litigation.

Our ongoing involvement in the port industry and connections in the public policy arena have enabled us to consistently achieve positive results for our port clients. Strong governmental relationships allow us to collaborate with agency staff to identify common ground-or, when necessary, to take tough stances to protect our clients' interests.
