The Federal Test for Title Navigability following PPL Montana v. Montana

When: April 27, 2012, 1-2 p.m. EST.

What: Stoel Rives attorney Jennie Bricker will discuss the federal test for title navigability in this Law Seminar International Telebriefing. On February 22, 2012, the U.S. Supreme Court issued its first in-depth analysis of title navigability in 75 years. The federal navigability-for-title doctrine determines whether the beds and banks of waterways are held in public or private ownership.

Bricker will moderate a discussion between panelists about how PPL Montana v. Montana clarifies navigability determinations on a river where the navigable capacity of one segment differs significantly from another segment. Topics will include:

  • The issues addressed in the PPL Montana case, how they were resolved by the Court, and how they affect the law of title navigability
  • How this case is likely to influence state policies and practices in claiming title to rivers and lakes
  • Impacts of the decision on trial and appellate litigation strategy
  • Implications for private riparian landowners
