Construction and Design

The firm provides legal services to owners, contractors, architects, engineers, subcontractors, construction managers, material and equipment dealers and suppliers throughout the construction industry and design profession. Our lawyers have backgrounds in engineering and accounting, as well as field experience in both public and private construction projects. We often travel to the client's office or to the project site, where personnel and records are more conveniently available. Because construction and design work is not localized, we provide services for projects throughout North America and abroad.

Agreements
We are experienced in drafting, analyzing, and negotiating a variety of specialized agreements involved in the design and construction process including competitive bid documents, requests for proposals, prime contracts, consulting agreements, joint venture agreements, purchase orders, subcontracts, contract specifications and others.

Disputes
Our lawyers have extensive experience in the resolution of disputes by negotiation, mediation, arbitration and litigation. We practice before state and federal courts, as well as various government boards of contract appeals. Our work involves preparation and resolution of claims for additional compensation and other damages due to changes, defective work, differing site conditions and delays. We assist small contractors in matters before the Small Business Administration. We are also experienced in filing, prosecuting and defending lien and bond claims and in handling disputes arising out of the public contract bid process.

Bonds and Insurance
Our construction and design lawyers are experienced in the use of performance and payment bonds, lien release bonds, and insurance as key elements of construction and design agreements.

Associations
Firm attorneys are active participants in the Idaho, Oregon-Columbia and Washington chapters of the Associated General Contractors of America, Inc. (AGC) and are members of the national AGC. The firm is also a member of Associated Builders and Contractors, Inc., the Asphalt Pavement Association of Oregon, the American Institute of Architects and the Construction Specifications Institute. Our construction and design lawyers are active in the Washington State Bar's Public Procurement and Private Construction Law Section and initiated, and are active participants in, the Oregon State Bar's Construction Section. Firm attorneys participate in numerous educational programs for the industry, including editing and authoring continuing legal education publications and speaking at numerous construction and design law seminars.

Legislation
An important aspect of our work is a deep involvement in legislative activities pertaining to the construction and design industry. We have participated in drafting many major legislative proposals in this field, including the Oregon Public Contract Law.
