Environmental Insurance
We assist businesses and landowners in recovering for environmental liabilities under their historic insurance policies. We help clients prove the existence, terms and conditions of their policies, the amount of their covered loses and to overcome insurance company reliance on policy exclusions. In particular, we have been successful in overcoming the "hindsight bias" often relied upon by insurance companies: explaining that policyholders should not be judged by Twenty-First Century standards for activities that occurred many decades ago with old insurance policies; e.g. those that do not have absolute pollution exclusions. We have secured defense coverage, environmental investigation and cleanup funds for policyholders from their insurance carriers at contaminated sites around the country.

Title Insurance Industry
We represent title insurance companies in formation and licensing, qualification to conduct business and title insurance/escrow litigation before the courts.
