Per Ramfjord and Steve Galloway discuss in Law360 a recent Migratory Bird Treaty Act (MBTA) ruling by the U.S. District Court for North Dakota. In United States v. Brigham Oil & Gas LP, the court dismissed misdemeanor criminal charges against three oil and gas companies for violation of the MBTA. The charges stemmed from the incidental death of migratory birds through contact with oil reserve pits operated by the defendants.

The ruling represents the latest in a series of cases that have dismissed criminal charges involving the inadvertent taking of migratory birds under the MBTA.
