Tax attorney Greg Jenner was quoted in Law360 in an article titled “Tax Guidance Maintains Sunny Outlook For Solar Developers,” published June 25, 2018. (Subscription required.) The article discusses guidelines for solar power developers, recently issued by the Internal Revenue Service, that outline requirements for eligibility for the federal investment tax credit (ITC) and for what the start-of-construction date must be for a project in order for it to qualify for the full ITC.

The IRS guidelines allow solar projects to qualify for the full ITC either by starting physical work of a significant nature or spending at least five percent of the project's total cost by the end of 2019, welcome news to the solar industry as a “partial mitigant” to the four-year tariff imposed by the Trump administration in January on imported solar cells and modules. 

“Everyone can breathe a sigh of relief, it's finally out there,” Jenner said. “It's not dramatically different at all from the wind PTC guidance. If there are any changes, they're on the margins.”
