Elliott Forest Not for Sale: Oregon Supreme Court Upholds Constitutionality of ORS 530.450

Environmental attorneys Kirk Maag and Max Yoklic authored an article for the Oregon Real Estate and Land Use Digest titled “Elliot Forest Not for Sale: Oregon Supreme Court Upholds Constitutionality of ORS 530.450,” published December 2019. In the article, the authors discuss a recent Oregon Supreme Court decision affirming the court of appeals’ reversal of a Department of State Lands final order that approved the sale of a parcel of state-owned timberland to a lumber company. The authors highlight the court’s analysis of the constitutionality of ORS 530.450, which prohibits the Department of State Lands from selling certain lands in the common school fund.
